Hong Kong High Court Rejects Government’s Request to Ban Protest Song, Upholding Freedom of Speech

The Hong Kong High Court (High Court) on the 28th rejected the Hong Kong government’s request to stop the online distribution and broadcasting of the song “Glory to Hong Kong” sung during protest demonstrations. After the Hong Kong National Security Law (National Security Law) comes into effect in 2020, it is unusual for a court to issue a judgment in favor of freedom of speech.

The government had sought a high court order making it illegal to perform or broadcast the song in Hong Kong on national security grounds, but Judge Anthony Chan said: We will distance ourselves from any lawful conduct related to this song.”

“Courts must also focus on protecting the fundamental rights of third parties who may be adversely affected,” she wrote. Government can appeal.
