In it, the cosmic Bulgarian song “Izlez e Delho haidutin” sounds in a composition called “Creation of the Earth”. The blockbuster is currently in theaters and stars superstar George Clooney. Nothing strange so far, the song choice fits the plot perfectly. The problem is that the singer of the song – Valya Balkanska, understands that she sings for Hollywood from the media. Can he sue the studio? “In order to claim anything, the claims must be established. Be clear that this is the sound recording that was used. Do a specialized examination to determine if it is the original or if it is some kind of remix,” he explained to “Standard” lawyer Momchil Mladenov.
A fan of BG folklore and a successful composer in Hollywood stole the cosmic “Delo haydutin” from us. Thomas Bergersen, the author of the piece, mixed the Rhodope song for “Utrelandia” in such a way that even Valya Balkanskii herself did not recognize her voice at first. “In the beginning, it was done in such a way that I couldn’t recognize myself. And I said that it wasn’t mine. Later on, it became clear that it was me and that it was the whole song. Someone else doesn’t perform it like that,” Balkanska told “Standart” yesterday. . In front of BNT1, the Norwegian admitted succinctly that he used part of “Delo”. Since 2006, Thomas, together with his colleague Nick Fenix, has been running one of the most successful film music studios in LA – “Two Steps From Hell”. The two have a hand in the soundtrack of hits like
“Avatar”, “Pirates of the Caribbean”, “The Chronicles of Narnia”
“Twilight”, “Harry Potter”. However, his author’s project “Illusions” is strongly influenced by BG folklore. The song “Starvation”, for example, was performed by “The Mystery of Bulgarian Voices” and was based on the folk song “Aishinko, pilya shareno”. It voices the trailer for the movie “Doctor Who: The First Question”. In the same album, Elitsa Todorova, who made a sensation at Eurovision with Stundji, sings the vocals in the song “Soulseeker”, and Vladislava Vasileva – in “Rada”, “Femme fatale” and “Dreammaker”.
Balkanska, however, has neither the money nor the strength to seek its own from Bergersen. He believes that the state is responsible for the stolen song, which is a national treasure. “We don’t really have the legislation, the tools to counter it,” Petar Yanev, the bagpiper with whom Valya works, told “Standard”. According to him, only media noise will not change things.
“In order to have a violation of the rights of Valya Balkanska, the original sound recording with her voice must have been used. If someone else performed the song and their rights have been settled with the producer of the film, unfortunately she cannot have any claims. This, that we associate her with this song does not give her exclusive rights to sing it. It is a folk song and anyone can perform it without infringing copyright, the lawyer explained to “Standard”.
