his house is taking on water after a catastrophic roof treatment

Mathilde is 30 years old and is what we call “first-time buyers”. She has just made her first real estate purchase. Unfortunately, not everything went as hoped. In October 2020, she therefore bought a house at a price of 268,500 euros. The sale is supervised by a real estate agent who advises the saleswoman to have
moss removal of the roof, before the transaction.

The saleswoman accepts and pays 3,700 euros to a craftsman found, a priori, on the Internet. The purchase is then formalized at the notary, who does not ask for the invoice and the decennial insurance of the craftsman mandated for the defoaming. In November, Mathilde embarks on renovation work and discovers recent humidity points all over the roof… She immediately calls in a roofer to ask for his opinion.

He informed him that the defoaming was carried out with a karcher. Result: the tiles are porous and as soon as it rains, Mathilde’s frame takes on water. He also notes that the tiles which have not been treated during defoaming are themselves in perfect condition. Subsequently, a bailiff goes to Mathilde’s home and discovers pieces of garbage bags hidden under the tiles

The craftsman would not even be of the trade

After these revelations, Mathilde contacted the craftsman who carried out the defoaming. The latter minimizes his responsibility by indicating that he did only a simple “cleaning of the roof”, and that these inconveniences are not his fault. While carrying out her investigation, Mathilde discovered that the professional evolves in the sector of “non-food retail trade on the markets” and not at all in the field of roof renovation ! He would therefore have no insurance, despite the advertising he ostensibly displays on his website.

The icing on the cake: the craftsman never responded to the registered mail sent by Mathilde. On the other hand, he would have threatened him by telephone. A claim has been made to home insurance. An expert went on site but, at the material time, Mathilde was not the owner … Insurance cannot therefore help him in this dispute..

Today, Mathilde finds herself in a very delicate situation. The craftsman does not seem to be of the trade, he would not have decennial insurance and as he was mandated by the saleswoman, and not by Mathilde, current owner, the field of action is limited. The recovery work for all defects amounts to around 24,000 euros, or 10% of the price of the house.

At present, Mathilde was unable to carry out her renovation work because of this failing roof. She therefore cannot live in her house… However, every month, she repays a loan for this. She contacted Julien Courbet to finally take charge of the roof repair work …
