High Court Rules in Favor of Woman Seeking Deceased Husband’s Sperm

The woman, who is not named, wanted another child with her husband. He died shortly before New Year’s Eve and was taken to a hospital in Perth after his death.

Hospital did not cooperate

The woman went to the High Court of Western Australia because she wanted to have his sperm removed from his body. This had to happen quickly, otherwise it would no longer be viable. The hospital in Perth refused to cooperate with her request.

The judge ruled that the woman may have the sperm removed from the body, report Australian media. In fact, the hospital was reprimanded by the judge because it should have helped the woman immediately. Now she unnecessarily underwent ‘a traumatic experience’, the judge said.

The 62-year-old woman and her husband had two children who died in two separate accidents. They had been working on an IVF process and a surrogate mother for some time to have a third child, but that was always delayed.

Not to father a child

Although the judge decided that the woman can have the sperm removed from her deceased husband, she is not allowed to do anything with it. In Western Australia it is not permitted to conceive a child using sperm from a deceased person. If the woman still wants this, she must go to court.
