This Tuesday morning, Montpellier Administrative Court ruled that the Department of Hérault must return the speed to 80 km/h on the roads. And this from June 1st. The League Against Road Violence had introduced a procedure to denounce the decision of the Departmental Council of Hérault to increase the speed to 90 km/h on 360 km of roads, since September 2020.
This Tuesday, the judges of the administrative court of Montpellier who had put the case under advisement, canceled the 25 decrees of the Department. A judgment that is not suspensive, even if the community appeals; the 80 km/h signs will have to be planted from June 1st.
Defect of form
The court holds a defect of form for the cancellation of the 25 orders attacked by the League of road violence, “tainted by insufficient motivation”. And judges that, “The mention used identically in these 25 decrees according to which these departmental roads have all the characteristics required to raise the speed to 90 km / h, without specifying the reasons which made it possible, in particular with regard to the accident rate, the increase in the maximum authorized speed on each of the sections of road concerned, was insufficient to justify these decisions”. A judgment that could set a precedent.
