The defendant is also a former Karo Paminal of the Propam Polri Division Hendra Kurniawan sentenced to 3 years in prison and a fine of Rp. 20 million in relation to a case involving the former Head of the Indonesian National Police’s Head of Propam Propam division Freddy Sambo.
The panel of judges at the South Jakarta District Court (PN) assessed that Hendra had been proven to have been involved in the crime obstruction of justice or obstruction of the investigation regarding the premeditated murder of Nofriansyah Yosua Hutabarat alias Brigadier J.
“Sentenced a sentence against the defendant Hendra Kurniawan with imprisonment for three years,” said chairman of the panel of judges Ahmad Suhel when reading out the verdict at the South Jakarta District Court, Monday (27/2).
In making his decision, the judge also considered a number of aggravating and mitigating circumstances for Hendra. The thing that was aggravating, Hendra was considered to be convoluted in the trial. The defendant was also considered to have shown no remorse and as a member of the National Police had not carried out his duties in a professional manner.
Meanwhile, the mitigating factors are that the defendant has never been convicted and Hendra is considered to have family dependents.
Hendra is considered proven guilty of violating Article 49 in conjunction with Article 33 of Law Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.
This decision is the same as the demands of the public prosecutor who want Hendra to be sentenced to three years in prison and a fine of IDR 20 million, a subsidiary of three months in prison.
Obstacles to the investigation regarding the handling of the premeditated murder case of Brigadier J were carried out by Hendra together with Ferdy Sambo, Agus Nurpatria, Arif Rachman Arifin, Irfan Widyanto, Chuck Putranto, and Baiquni Wibowo.
Sambo was sentenced to death by the panel of judges at the South Jakarta District Court because he was found guilty of premeditated murder and without the right to commit an act that caused the electronic system to not function properly.
