Help with a loan problem? (Law, money, finance)

I sold a laptop on eBay classifieds. It was agreed that a deposit would be made (which was also done in person) and the remaining payment on August 1st. happens. A contract was drawn up, which was also signed by both sides, and we were supposed to keep the ID as a deposit and security.

The above-mentioned seller assures that the named item is the sole property of the seller, has not been reported as stolen and is free from third-party rights.

By mutual agreement, the purchase price to be paid amounts to a total of € 300.00.

A deposit of € 35.00 must be paid on July 24th, 2020. With this deposit and his signature, the buyer undertakes to pay a remaining amount of € 265.00 by August 1st, 2020 at the latest. Until the purchase price has been paid in full, the seller retains the buyer’s identity card as a deposit.

The seller expressly emphasizes that liability for material defects is excluded under EU law and that it is a private sale. The sale takes place [im Übrigen] to the exclusion of any warranty or other liability on the part of the seller. A right of withdrawal is completely excluded in the case of a private sale.

But now the buyer only got excuses that she doesn’t have time to answer and that it is stressful for her because her sister is in the hospital … Of course we understand that, but we also need the money and because she works by herself from not reporting we become suspicious.

What steps can we take?
