Helmet, sidewalks, speed… What is mandatory or forbidden to use a scooter


The use of the scooter, electric or not, respects the rules of circulation on public roads. Let’s take stock of current regulations, while injuries increase.

On Monday, 22 August 2022, a 15-year-old girl and a 17-year-old man died when they were hit by a private ambulance in Lyon, while riding an electric scooter together. In the night between June 30 and July 1, a 20-year-old man died in Le Havre after an accident with a car. In January, a 21-year-old man lost his life in Déville-lès-Rouen.

Fatal accidents involving scooter users are on the rise, in particular electric ones (about fifteen people have died since the beginning of the year), although they remain few, given the large number of regular or occasional users. Let’s take stock of what is prohibited, authorized and mandatory on a scooter.

Rules to be followed for motor vehicles

Road safety site goes beyond the rules to follow when using an electric scooter. They remember those for driving a car: being insured through liability insurance (for a rented scooter the company must also take out insurance for users), not to be used phone or headphonesnot to be under the influence of alcohol or drugs. The use of an electric scooter is prohibited children under 12 years old and it is forbidden carry a passenger.

Traffic must be active cycle paths or lanes, in bus lanes or, failing that, on roads with a maximum speed of 50 km / h. It is therefore forbidden to circulate on the pavements, unless the mayor of the city has authorized it and in this case it is a moderate pace (6 km / h). It is possible to use the pedestrian paths, but also at a reduced pace. Outside built-up areas, users must only use green roads and cycle paths.

Finally, it is possible to park your scooter on a sidewalk if it does not obstruct the passage of pedestrians, unless the municipality decides to prohibit it.

Mandatory equipment

The horn, the rear and front position lights, the braking system and the reflective devices are mandatory on electric scooters.

User must wear a reflective clothing, such as yellow vest, at night or in case of reduced visibility. the wearing a helmet for the user it is not mandatory but strongly recommended. Finally, cars must be limited to 25 km / h to travel on public roads.

Punishments

Don’t believe that you will escape punishment if you don’t follow these rules of Traffic Laws. Therefore, failure to comply with traffic conditions (cycle paths, transport of a passenger) leads to a 2nd class fine of € 35. It is the same amount for a defect in retro-reflective equipment (at night or in the case of reduced visibility), if you are pulling or pushing a load or if you are being towed.

For traffic on a sidewalk or with a rampant scooter, it will be a 4th class fine, i.e. € 135. Finally, it counts € 1,500 (5th class fine) if you drive with a car whose maximum speed per design is greater than 25 km / h.

Which machines are affected?

All of these rules, effective October 25, 2019, apply to motor vehicles for personal transport, the EDPMelectric scooters, gyro pods, hoverboards or even single wheels.

Bicycles, electric or not, are also affected. Users of scooter without motor they are considered pedestrians: they must therefore walk on the sidewalks and use the protected passages. They cannot use the cycle paths.
