The fine coal trial resumed on November 27, 2023 in Ouagadougou. We note the presence of the expert Moussa Gomina. As soon as the trial resumes, Essakane’s defense raises the regularity of the composition of the prosecution. The mine’s lawyers maintain that two members of the public prosecutor’s office were appointed in another jurisdiction by a decree taken by the Council of Ministers.
“These two members are no longer substitutes for the prosecution according to the decree,” maintains Mr. Kopioh, lawyer for the Essakane mine. The prosecution, for its part, believes that he is there with dignity and that there was no request from the defense to this effect before the judge who could have decided.
The defense finally asks the court to take into account the decree taken by the Council of Ministers which appoints judges Nombré and Barro.
After suspension, the court joined the defense request to the merits and began the hearing of the expert Arsène Yonli for his hearing on sampling.
