Health – Dresden – Court: Hotel restaurants remain closed to guests – Health

Dresden (dpa / sn) – Restaurants and breakfast rooms in hotels currently have to remain closed to their guests. The Dresden Administrative Court confirmed the corresponding corona rules in a decision on Thursday (Az .: 6 L 84/21). Hotel stays are currently permitted for professional reasons.

A Dresden hotel company had wanted to enforce by urgent application that it could serve food and drinks in the hotel’s own restaurant to its overnight guests. The approved alternative of room service is no better because there are more contacts than in restaurants. Because of the high staffing requirements, entertaining guests in the room is also not economical. In addition, hotel restaurants are comparable to company canteens, which are allowed to open under certain circumstances.

The administrative court rejected the urgent application. The court announced that the regulations for company canteens should be interpreted narrowly. The canteens are allowed to open when it is not possible to eat at work. Hotel guests, on the other hand, could dine in their room. In addition, the food on offer in canteens and canteens is intended for employees. That is not the case with hotels. A complaint against the decision can be lodged with the Higher Administrative Court in Bautzen.
