Monday August 16, room 1 of the Thionville judicial court, the atmosphere is heavy. In the accused’s box, a man in his thirties. His victim can hardly contain his emotion. A “complicated relationship”, according to the defendant, during which disputes and violence are to be noted. This Monday, the thirty-something had to answer for three counts of violence exerted on his ex-companion.
In January 2021, it is a twisted wrist “to hurt”, underlines Marie-Pierre Chateauvieux for the public prosecutor. At the beginning of February, “you threw Madame down the stairs, blocked her head on a step, kicked her twice,” lists President Marie-Cécile Dupuy. “She tried to run away, so you grabbed her by the belt to throw her and her head would have hit the concrete. Finally, you would have dragged her to the sofa and threatened to kill her and then commit suicide ”.
The doctor’s report is in tune: a large number of bruises, abrasions, contractures which are worth two days of ITT to the victim. The 30-year-old ends up in custody, a penal composition measure is refused by both parties and the defendant receives a training course to raise awareness of violence (which he had not yet been able to attend at the time of the hearing) . Before the court, he recognizes the facts, speaks of “a moment of impulse. “Regular arguments are evoked, a difficult relationship with the family of the defendant as well as the announcement by the victim of the end of their relationship.

A new argument
The couple finally reformed and, last July, a new altercation broke out in the car. “You slap Madame, take her phone.” “There again, the man justifies:” A sentence irritated me, I put a setback under the blow of the emotion. For me, it’s his glasses that I type. The victim’s cheek bears witness to the contrary. The complainant then stops the vehicle and claims its property. “I gave her the phone back, and she put me a pie.” It was deserved. “The young woman (who will also have to answer for this gesture) rewinds, speaks” of a sickening blackmail so that I leave my work “. Indeed, both are employed within the same Luxembourg company and have to meet regularly.
Authorities notified, judicial control is in place: the accused is prohibited from coming into contact with his victim. “And a few days later, you send him long emails. You are blackmailing it emotionally, ”says the president. The thirty-something is then arrested, taken into custody.
In fine, the court agreed with the prosecution’s requisitions, condemning the defendant to twelve months in prison, six of which were suspended, an obligation to work, to take care of domestic violence and to compensate his victim. He is also prohibited from coming into contact with his victim, appearing at his home or workplace.
