The High Court of Cassation and Justice postponed on Wednesday, April 7, the decision in case of confirming the solution of the General Prosecutor’s Office of renouncing the criminal investigation against the PNL MEP Rareş Bogdan.
The judges decided to postpone the trial for April 21, after Wednesday’s deadline, a lack of procedure was found, on the grounds that the summons was sent to Cluj-Napoca, not to Rareş Bogdan’s home in Bucharest.
Prosecutors The criminal investigation and forensic section of the Prosecutor’s Office attached to the High Court of Cassation and Justice ordered the waiver of the criminal investigation for forgery and use of forgery in the case of Rareş Bogdan. However, the prosecutors’ decision must also be confirmed by the judges.
The details of the case were revealed on Tuesday by the lawyer Gheorghe Piperea.
“Two years ago, one of my clients filed a criminal complaint against Rareș Bogdan, for embezzlement and false statements. One month ago, the Prosecutor’s Office attached to the HCCJ issued an ordinance classifying the complaint regarding embezzlement (it was considered that the accused “did not have the quality of legal or factual management of the amounts due to Realitatea Media as being collected from the contracts publicity ”). For the false accusations, it was considered that the facts exist, but that they are not so serious as to justify the expenses generated by the criminal proceedings, in relation to the possible sanctions applied (poor motivation…), so the prosecutor ordered the waiver of the criminal investigation and sending the file to the preliminary chamber, for confirmation or refusal of this provision. If the judge confirms, Rareș Bogdan escapes the criminal investigation, even if the prosecutor found in black and white that the forgery exists *. If, on the contrary, the judge overturns the prosecutor’s solution, then the accused becomes a “criminal in public office”, in the sense of the campaign he supported so ardently, from the wave of protests.
The deadline in the preliminary chamber is tomorrow, at 9 o’clock, room P 8, complete c32 cp, at the criminal section of the HCCJ.
