Based on a ruling by the Supreme Court in January 2024, thousands of borrowers in Austria could soon be able to look forward to a refund of up to several thousand euros. In its most recent ruling (2 Ob 238/23y), the Supreme Court (OGH) declared a clause illegal that included a one-off processing fee of four percent of the loan amount as well as additional expenses and costs that were considered non-transparent and inadmissible. A reclaim of the additional fees and loan charges may be possible retroactively for up to 30 years.

Requirements for a refund of loan fees and first steps:

In order to claim back loan processing fees, a few conditions must be met. You can look for the following keywords in your contract:

  • Processing fee, credit fee, credit processing fees, transfer fees, collection fees, postage and printing costs, delivery fee, printing costs, account management fee, appraisal fee
  • The loan agreement was concluded between a bank and you as a private individual, as a consumer.
  • The loan may still be running or may already have been paid off or completed.
  • It is a housing, home or consumer loan.
  • The contract was concluded up to 30 years ago (from the year 2000*).

Examples of repayment amounts based on a real estate loan from 2005:

  • Loan amount: € 700,000
  • Processing fee: 3% + additional fees
  • Resulting in a possible refund amount of: up to € 21,000
