In a letter dated August 20, 2021 to the lessor Nanterre Coop Habitat, the National Union of Independent Tenants (UNLI) from Nanterre (Hauts-de-Seine) is requesting full reimbursement of the maintenance costs of the green spaces of 38 residences managed by the lessor over the last three years. The Union considering that these sums “could not be recovered”. Amount Required: 1 626 830, 92 euros.
7,236 housing units concerned
“Of these 38 residences, 70% are part of the heritage of the lessor Nanterre Coop Habitat. It’s huge ! Alexandre Guillemaud, president and founder of the Nanterre branch of the UNLI, does not take offense when he discusses the affair. Supported by a court decision, it thus demands immediate reimbursement of the amount withdrawn from tenants over the past three years.
This letter summarizes over the last three years the taxes received for maintenance of green spaces for 7,236 housing units. ” That is 224.82 euros per accommodation over the past three years, ”summarizes Alexandre Guillemaud.
For years, Nanterre Coop Habitat has recovered from its tenants the maintenance costs of the green spaces of its residences, these amount to hundreds of thousands of euros per year. However, the Court of Cassation specified, on November 30, 2005, via judgment n ° 04-14508 of the 3rd Civil Chamber, that the charges for green spaces not reserved exclusively for tenants could not be recovered from them.
When contacted, the lessor Nanterre Coop Habitat did not respond to our requests on time.
Access to the green spaces in question
According to Alexandre Guillemaud, Nanterre Coop Habitat justifies these taxes with regard to of the private character green spaces falling within the rental charges. “However, most are public and are used by people other than residents. Many paths have become public passages, ”says the latter indignantly.
The case therefore remains in suspense for the 7,236 tenants of the 38 residences as well as for the lessor. In the event of reimbursement, Nanterre Coop Habitat would do so deadlock on 542,000 euros on average per year.
