Essen/Hattingen – As of today (May 15, 2023), a Hattinger has to answer to the judges of the 24th Criminal Court in Essen. Prosecutors have accused him of sexually abusing his underage son on several occasions.
Crimes against your own son
An Internet report by the underage son to the police got the process rolling. The public prosecutor’s office on the first day of the hearing in the Essen district court classified the later investigation result as a crime.
“You can’t excuse what happened, the whole family system was shaken by the acts, but my client won’t let his life be ruined,” said lawyer Heike Tahden-Farhat, who represents the young victim.
20,000 euros in damages – allegations were admitted
Criminal Defense Attorney Dr. Right at the beginning of the main hearing, Gregor Hanisch pointed out that there was a perpetrator-victim mediation between his client, the accused and his son, with whom his client no longer has any contact due to a court ban.
As part of this agreement, the man from Hattingen has now paid his son 20,000 euros in compensation for pain and suffering and has taken on a further 5,000 euros in therapy costs for him.
In order to avoid a testimony of the underage son of the accused, the two criminal defense lawyers of the accused Hattinger, attorney Peter Steffen and Dr. Gregor Hanisch, then a confession from her client.
He then described the crimes very factually and confirmed the crimes against his son that he was accused of in the indictment, i.e. a comprehensive confession. The Hattinger claims to have always been under the influence of alcohol during the crimes and thus disinhibited. To this day, the man from Hattingen does not claim to have recognized the motivation for his actions.
“I told him not to do that”
The first attacks are said to have taken place in 2017, when the boy got into the marriage bed at night because he couldn’t sleep. The indictment partly describes massive sexual acts by the father on his son, of which the sleeping mother claims not to have noticed.
Other acts are said to have happened in the children’s room and in a caravan during a holiday. The accused has always assumed that his son was asleep during his assaults, but this was not confirmed during the investigation, the son rather pretended to be asleep, so he was aware of the assaults. The son is said to have told his father several times that he should leave it alone.
After the criminal complaint, the accused’s professional and private PCs were confiscated as part of the investigation and the man from Hattingen was arrested and taken into police custody. He was released from this after a short time against corresponding registration requirements.
The representative of the public prosecutor’s office criticized the fact that the man from Hattingen took care of a correspondingly special therapy treatment for himself quite late, especially since the waiting times with these specialists are very long. The result of an initial therapy that the Hattinger underwent was then read out.
According to the statement of the co-plaintiff’s representative, the defendant’s underage son is not concerned with his father receiving a heavy sentence. In fact, he never wanted to see him again. But his father shouldn’t get away scot-free either.
The defendant, who has moved to another city, has now lost his family and his previous social contacts in Hattingen.
The large criminal court has scheduled four days of hearing for this process. Due to the comprehensive confession of the defendant, an earlier verdict is expected.
