Two days after Harvey Weinstein’s rape conviction was overturned by the New York Court of Appeals, the former movie mogul has been hospitalized. Weinstein’s attorney, Arthur Aidala, confirmed that he was admitted to Bellevue Hospital in Manhattan for a series of tests.

Concerns Over Weinstein’s Health

Weinstein’s attorney, Arthur Aidala, explained that the former movie mogul is in need of significant physical help. Aidala stated, “It seems like he needs a lot of help, physically. He’s got a lot of problems. He’s getting all kinds of tests. He’s somewhat of a train wreck health-wise.”

Weinstein’s Condition

The NYC Department of Correction spokesperson Frank Dwyer confirmed that Weinstein remains in custody while receiving medical treatment in the hospital. Weinstein’s prison consultant and DOC liaison, Craig Rothfeld, expressed gratitude towards the NYC DOC’s care and discretion in handling Weinstein’s medical issues.

Rape Conviction Overturned

On Thursday, news broke that Harvey Weinstein’s rape conviction was overturned in New York, with a 4-3 ruling suggesting prejudice occurred in the previous trial. The appeals court, the highest in New York state, ordered a new trial to take place. Weinstein is scheduled to return to court on May 1, as announced by the Manhattan District Attorney’s office, though the purpose of the hearing is not yet disclosed.

Going to New Trial

The District Attorney’s office emphasized their commitment to retrying the case, stating that they will do everything in their power to hold Weinstein accountable for the crime charged. The appeals court made it clear that under the system of justice, the accused must only be held accountable for the crime charged.

Weinstein’s Previous Conviction

In February 2020, Harvey Weinstein was found guilty of criminal sexual assault in the first degree and rape in the third degree following testimony from Miriam Haley and Jessica Mann. He was sentenced to 23 years in prison. As of now, Weinstein also faces a conviction in Los Angeles, ensuring his continued stay in prison even if a new trial is established in New York.
