Hardly any successful lawsuits against repayment of Corona aid

The pandemic has weakened many companies. That’s why the government has transferred emergency aid. If entrepreneurs have received too much money, they have to pay some back. How many are suing against this?

Wiesbaden – Of around 1,600 lawsuits against the repayment of excess Corona economic aid in Hesse, only two have been successful so far. The Ministry of Economic Affairs in Wiesbaden told the German Press Agency (as of August 21, 2024). The individual federal and state Corona aid programs were intended to mitigate the economic impact of the Corona pandemic and the government-imposed measures for companies and the self-employed.

In Hesse, the Kassel Regional Council is responsible for the early Corona emergency aid and the Gießen Regional Council is responsible for the later various Corona bridging aid. In the Kassel Regional Council area, 563 proceedings have been concluded and 313 are still open. “So far, no lawsuit has been successful, 69 proceedings have ended with a settlement,” the ministry explained (as of August 21, 2024).

There are 550 court cases pending in the Giessen district. This is where the two lawsuits were won. “In the other cases, the decisions were confirmed by the courts or the cases were terminated by withdrawal of the lawsuit or in some other way,” the Ministry of Economic Affairs announced.

957 million euros paid out under the first funding programme

According to the ministry, around 957 million euros were paid out in Hesse for 106,214 approved applications in the first funding program, the early Corona emergency aid to secure liquidity with ongoing operating costs such as rent and lease.
