Hamburg AfD is suing against night exit restrictions

Hamburg (dpa / lno) – The Hamburg AfD has announced a lawsuit against the nightly exit restriction as part of the Corona containment regulation. The urgent application was submitted to the administrative court on Wednesday by state chairman Dirk Nockemann and his three deputies, said an AfD spokesman.

The court confirmed receipt. It is one of a total of 15 urgent applications that are pending against the nightly exit restriction at the administrative court, said a spokesman. Three applications have already been rejected. The Higher Administrative Court had received two complaints.

“This curfew is the most brutal violation of fundamental rights to date during the corona crisis,” explained Nockemann in a press release. Compliance with the AHA rules is understandable. “But with the curfew, Maß und Mitte have been completely lost in Hamburg.”

Mayor Peter Tschentscher (SPD) defended the exit restriction that had been in force since Good Friday on Tuesday and announced an extension until the planned federal regulation came into force. “I am convinced that the exit restriction will have a very strong effect,” he emphasized. Hamburg is the only federal state that has a falling incidence of new infections in a weekly comparison. On Wednesday, however, the value rose in a weekly comparison from 134.7 to 150.0 new infections per 100,000 inhabitants in seven days.

Tschentscher had also referred to the low number of violations of the exit restrictions. Hardly anyone is out at night. It is crucial to limit private contacts.
