In the takedown request, Haier writes that the two integrations violate the company’s terms and conditions. The plug-ins “use our services in an unauthorized manner that causes significant economic harm to our business,” Haier wrote.
General terms and conditions do not affect individual open source code itself. After all, the open source code exists separately from the product/service, and someone who views and distributes code never has to have accepted the general terms and conditions of a product that does not use it. There are plenty of legitimate reasons to distribute code (e.g. research purposes, educational, etc.).
Use of the open source code may be against general terms and conditions, but that is the responsibility of the user, not the developer. By the way, I doubt this. If a device can be controlled locally, the user never needs to accept the terms and conditions of an ‘app’ or service.
