“The Telegram Letter Number 1221/2021 signed by the Kasum (Head of General Staff) and (on behalf of) the Commander-in-Chief is in order to prevent misunderstandings and procedural uncertainty if a TNI soldier is required to provide a statement in a legal event,” Hadi said as quoted by Antara. detik.com, Tuesday (11/23).

According to Hadi, the regulation, which was issued at the end of his term of office, only applies if TNI soldiers are questioned by law enforcement officials.

Hadi explained that the new rules for examining TNI soldiers actually show that TNI soldiers are subject to the law and military courts.

“I repeat, if a statement is needed, period,” said Hadi.

Therefore, Hadi continued, if the TNI Headquarters provides specific instructions on how to ask for information, then this clearly states that TNI soldiers are still subject to the law and military courts.

Previously, in the telegram of the TNI Commander, there were at least four points that emphasized the legal process. A total of 14 officials in military institutions were given the telegram.

Including, KSAD, KSAL, KSAU, KASUM TNI, Inspector General of the TNI, Pangkobagwilhan, Dansesko TNI, Danjen TNI Academy, Head of TNI, Dankodiklat TNI, Koorsahli Panglima TNI, Assistants to the TNI Commander, the DAN/Head of TNI Headquarters and lastly Dandenma TNI Headquarters .

“There are several incidents of summoning TNI soldiers by the police that are not in accordance with applicable legal provisions,” the commander wrote.

In the first point, it is stated that summons made to TNI soldiers by law enforcement officers to provide information on a legal event must go through the commander or unit head.

Then, the Commander also requested that the summons of soldiers who did not comply with the procedure could be coordinated with the law enforcers in question.

TNI soldiers who provide information to the apparatus can be carried out in their unit or at the office of the law enforcement apparatus in question, accompanied by a legal officer or unit officer.
