Habib Rizieq Shihab Sues Correctional Center Head for Umrah Permission

Habib Rizieq Shihab sued the Head of Class I Correctional Center (Bapas) in Central Jakarta (Jakpus) to the Jakarta State Administrative Court (PTUN). Attorney Habib RizieqAzis Yanuar filed the lawsuit because Rizieq was not given permission to perform Umrah.

“The lawsuit we filed at the Administrative Court against a letter issued by the Central Jakarta Penitentiary regarding our client Habib Rizieq Syihab’s prayer permit and also a letter of application for legal protection that we submitted regarding our client,” said Aziz Yanuar, in his statement, Tuesday (1/8 /2023).

Aziz said that his party filed a lawsuit against the State Administrative Decree issued by BAPAS Central Jakarta. In addition, his party has also sent a letter of request for legal protection which was submitted to several agencies, including the Indonesian Coordinating Minister for Political, Legal and Security Affairs, the Indonesian Menkumham, Commission III of the Indonesian Parliament, the Indonesian Attorney General’s Office, the Indonesian Prosecutor’s Commission, and the National Commission on Human Rights.

“This (letter) is intended to dismantle allegations of systematic human rights deprivation by the Central Jakarta District Attorney by not providing a recommendation for permission to carry out our client’s Umrah pilgrimage without clear reasons and common sense,” he said.

Aziz highlighted the reason the Central Jakarta Prosecutor’s Office did not allow his client to carry out the Umrah pilgrimage because it was related to the difficulty of supervision.

“That the reason that the Central Jakarta District Prosecutor’s Office made was the difficulty of supervising, this is very ridiculous and makes us laugh of course. Because it is clear that in the Saudi Arabia region the Indonesian government and of course including the Prosecutor’s Office have representatives who certainly can carry out the supervision referred to, in this case we are even ready to help finance the departure of parties who will supervise our clients if necessary so that our clients can exercise their human rights in worship which are protected by law,” he said.

Aziz added, the lawsuit and letter of request for legal protection that was filed was a legal effort to fight for Rizieq’s human rights which were given a law.

“So this proves that our clients remain law-abiding even though on many occasions our clients have always been victims of rotten political machinations that have harmed our clients,” he said.

“We will continue to make legal efforts provided by law in order to create justice for our clients,” he continued.

Previously, Habib Rizieq Shihab sued the Head of Class I Correctional Center (Bapas) in Central Jakarta (Jakpus) to the Jakarta State Administrative Court (PTUN).

Judging from the PTUN Jakarta Case Tracing Information System (SIPP), Monday (31/7/2023), Habib Rizieq’s lawsuit was registered with case number 339/G/2023/PTUN.JKT. Habib Rizieq registered the lawsuit on Friday (28/7).
