On the occasion of the presentation of two new consular judges of Grenoble commercial courtits president, Valérie Denu, took stock of theactivity of its jurisdiction. “We are not idle, since the start of the year, activity has skyrocketed”, she explains, recalling the figure of 582 collective proceedings initiatedrecorded at the end of October, compared to 366 last year, i.e. + 59 %. Compared to the pre-Covid period, i.e. October 2019, the increase is + 17% (497).
Business difficulties are increasing
Interesting aspect, underlines Valerie Denu :
“Liquidations now only represent 80% compared to 90% previously. Urssaf has nothing to do with this, if it had assigned normally, the figures would be different. 15% of the activity is recovery, and safeguards, which represented only 1 or 2%, rose to 5%.”
As is often the case, the procedures are very many at the tradespeople (21% of collective procedures) and inhotel and catering (15 %). “Paradoxically, the sector of construction represents only 15% of procedures, compared to the usual 21%. But when we talk to the profession, many are very worried, and I’m afraid things won’t stop there.”
Grenoble Commercial Court: record year for big cases
Recalling that Grenoble is a specialized commercial court (TCS)like only 17 others in France out of 134, it has jurisdiction to handle large cases, that is to say those concerning companies with more than 250 employees, or more than 40 million euros in turnover. , even international affairs.
“2023 is a record year. 17 files at TCS have never happened before. We processed between 3,000 and 3,500 jobs. We notably handled the Go Sport and Gap group, and we are proud to have saved practically all employment, with resale to Intersport. On matters handled at TCS, we have generally succeeded in saving employment, often through transfers.”
Amicable procedures
Marotte of Valérie Denu since her election, the president of the TC has wanted to recall the importance of amicable procedureconfidential. “When you come early, before the cessation of payment, we manage to save 70% of businesses.” 54 procedures of this type were opened in Grenoble as of the end of October, compared to 39 last year.
Two new consular judges
Thursday, November 9, the new judges of the Grenoble commercial court were presented before taking the oath on January 25, and being installed the next day.
Christophe Dansette and David Guimard, addressed a few words to their audience. The first, 64 years old, was an engineer in industry. Among others, he worked at Rhône-Poulenc, then Rhodia. He worked in the restructuring of industrial sites, particularly in the North of France, before taking charge of Vencorex projects, on the Pont-de-Claix site.
David Guimard is “geographer and lazy” by his own admission. After a doctorate in geography and climatology, he worked as a quality expert, before becoming a mountain guide, and finally resuming his studies: master’s degree in quality management, then a master’s degree in business management and administration, with always as a leitmotif: “do well, by working less”.
