Green pass but not for everyone: the unresolved issues

A “yellow” on the green certificate: but the managers of the activities (restaurants, gyms, cinemas, theaters, etc.) and the staff who work there are obliged do they also have a compulsory Green Pass or not?

What is it that doesn’t add up

The text of the law decree reads like this: “They are the owners or managers of the services and activities for which the obligation of the green pass a has been introduced to verify possession of suitable certification. In case of violation, a fine of between 400 and 1000 euros can be raised both for the operator and for the user. If the violation is repeated three times on three different days, the business could be closed for 1 to 10 days“. We only talk about verification, also because there is no vaccination obligation in Italy: this means that managers and staff are required to check the public but not that they themselves are obliged to have green certification. The Press release number 30 of the Council of Ministers of 22 July, however, says something different: the Green pass will be necessary for “play or log in“some activities including restaurants, shows, sporting events, museums, swimming pools etc. The difference, this time, is the verb perform, so all workers should have the green certificate too.

The contradiction

There is no doubt that this is a minefield, raise your hand if you have understood every comma of the new law decree. According to the information available at the moment, if it is established that customers who go to a restaurant or any of the other places provided for by the decree will have to show the Green pass, it is not so clear whether those who work there should also have it: who goes to the theater or cinema will have to have the Green pass but is it also mandatory for the staff who work? If a user wants to train in the gym he will have to show the green certificate, must his personal trainer also have it? If so, whoever carries out an activity would be practically forced to get vaccinated, but in Italy there is no vaccination obligation: one account is the customer, limited in their activities, another is the worker. This passage was never clarified by Draghi during the press conference the other night. Evidence of this is that the Decree Law of 22 July art.9 bis “I use Covid green certifications“Which will be valid from 6 August 2021, only lists all the activities for which it is necessary”access to the following services and activities“, But does not specify the same for the managers and workers of the same. The only specification that is read is that “the provisions referred to in paragraph 1 do not apply to subjects excluded by age from the vaccination campaign and to subjects exempt on the basis of suitable medical certification issued according to the criteria defined in the circular of the Ministry of Health”, Therefore the subjects who for medical reasons cannot get vaccinated and all the Under 12s for whom vaccination is not yet foreseen.

The Green pass starts on the wrong foot

This theme will undoubtedly be addressed in the next few days when we “discover” the contradiction: to dine indoors, the customer must show the certificate but the same is not required from the waiter and all the dining room staff? Technical problems: many Italians are having enormous difficulties in downloading the Green pass: the two switchboards that the Ministry of Health has set up to clarify the issue and give information are on a tailspin. Yesterday, throughout the day, at 800 912191 you hear a recorded message repeating: “Dear customer, it is not possible to answer your call at this time“. It will be necessary to arm yourself with patience, the road seems all uphill.
