On Wednesday and Thursday, the House debated the cabinet’s corona urgency law. At the insistence of the House, the law states, among other things, that the fine for violating the corona measures will be reduced from 390 euros to 95 euros. The fine also no longer leads to a criminal record.
Criminal record
For people who had already received a criminal record for this reason, it will expire. But that does not apply to the fine. “That feels unjust,” said Farid Azarkan (THINK) during the debate. Can’t something be done about that, he wanted to know from Grapperhaus.
But the minister sees no possibility for that. “Those are judicial decisions. I think that the division of powers means that we must respect that. ” Also punitive orders imposed by the Public Prosecution Service is not something Grapperhaus wants to intervene on.
Lawyer Frank van Ardenne, who, on behalf of the ‘Schiedam cake eaters’, among others, has asked for remission of their corona fine, does not understand Grapperhaus’s argument when it comes to the Public Prosecution Service. “The lion’s share of the corona fines has been imposed by the Public Prosecution Service, no judge was involved. The minister can simply give instructions to the Public Prosecution Service, in which it is instructed to correct the fines. Then the amount of the fine can simply be adjusted downwards ”, he says in a response.
According to Van Ardenne, about 98 percent of the corona fines were imposed through a punitive order by the Public Prosecution Service.
