Grandmother Found Not Guilty in Suspicious Accident Case | National Forensic Science Calls for Vehicle Manufacturer Data

Last week, we reported that a grandmother who lost her grandson and was booked in a suspicious accident in Gangneung was found not guilty.

The National Institute of Forensic Science, which directly assessed the accident, said, “To accurately determine the cause of the accident, vehicle manufacturers must provide more data.”

The van, which was running with a loud noise, floated in the air and then crashed.

12-year-old Dohyeon died in this accident.

To find the cause of such an accident, which is presumed to be sudden acceleration, an automobile accident recording device (EDR) analysis is conducted, which stores the car’s state for 5 seconds immediately before the accident.

The only data that the National Forensic Service can secure is the data remaining in EDR.

Five seconds before the accident, the state of the car must be checked to see how the electronic control unit and ECU software operated, but the defect cannot be clearly identified.

The ECU is the brain of the car and is the core software that controls the engine and automatic transmission. However, the investigation is limited because the vehicle manufacturer does not disclose the ECU source code, citing ‘technical security issues’.

Even if the National Forensic Service requests data, the manufacturer does not have to provide it under current legal regulations.

″If (the amendment to the Product Liability Act) is passed, we will be able to objectively see whether any data that can be analyzed is missing… ″

Therefore, the National Forensic Service, which investigates sudden acceleration accidents like the suspected sudden acceleration accident in Gangneung last December, also believes that the Product Liability Act needs to be revised.

In a reality where even the National Forensic Service receives limited data, it is virtually impossible for victims of suspected sudden acceleration accidents to prove ‘vehicle software defects.’

“The manufacturer has been fighting for 10 months and has not said a single word. In the end, even though all responsibility lies with the manufacturer… ″

The bereaved family, who personally collected about 50 pieces of legal evidence, including CCTV, for over 10 months to determine the cause of the accident, is appealing to the National Assembly to improve the current irrational reality.
