Kozhikode | Grand Mufti of India Kanthapuram AP Abubakar Musliar submitted a petition to the Prime Minister, Home Minister, Law Minister and the Law Commission expressing their concerns regarding the implementation of the Uniform Civil Code. The petition demanded that the Central Government should reconsider the issue as the Unified Civil Code would lead to the loss of multiculturalism and diversity, which is the main feature of India, and create insecurity in the country.
India has achieved the glory and development it sees today only because of its cultural and religious diversity. The letter indicated that these diversities do not harm the country’s progress and that the government should treat all groups equally without the distinction of majority and minority in a secular democratic country. Kanthapuram had earlier opined that the Uniform Civil Code is not an issue affecting only one group and it is a denial of the rights given by the constitution to a pluralistic society.
Relevant parts of the petition: Multiculturalism and diversity are the main characteristics of India as a nation. Beliefs, customs, birth-death-marriage ceremonies and inheritance laws are very different in different parts of the country and among different groups. It is because of this cultural diversity that India has grown and become the center of attention among the nations of the world. The cultures and beliefs followed by the citizens of our country do not stand in the way of achieving any goal or achieving scientific and technological progress. In a secular democratic country, the rights of minorities should be treated as equal to those of the majority. Indian culture as we see it today has evolved from the unique values of all the castes.
Knowing the diversity of Indian culture, the framers of the constitution framed the fundamental rights in such a way as to include the rights, religious practices and rituals of all the sections of the country. Legislation that intrudes on such rights is worrisome. The fact that the right to follow the ways and customs of the believers in their own form will always exist will make our democracy more beautiful. Every religious person should have the right to follow traditional practices that they hold sacred.
If the government is aware of any deficiencies in the personal rules, it can try to find a solution together with the respective religious leaders. Apart from that, discussing the personal rules of any group in front of the society will create insecurity. Various tribal groups have come forward expressing concern over the Uniform Civil Code. Various states have also passed laws keeping in mind the concerns of such sections. Kanthapuram also demanded in the petition that an appropriate decision should be taken to protect the fundamental rights provided by the constitution to the minorities of the country at this stage.
