Mexico City. Governors from all over the country presented an amicus curiae (friend of the Court) before the Supreme Court of Justice of the Nation (SCJN) to warn about the consequences that the elimination of informal preventive detention would bring.
The 32 state leaders agreed that the elimination of informal preventive detention would have a serious impact on public safety.
“We cannot fail to point out the collapse of the federal courts that would arise from the need to be forced to analyze each and every one of the requests for changes in the precautionary measures that exist for informal preventive detention,” it was stated.
They even requested to maintain constitutional supremacy over any international norm, this due to the ruling issued by the Inter-American Court of Human Rights (CoIDH), in which the Mexican State was condemned, after declaring the aforementioned precautionary measure unconventional.
The members of the National Conference of Governors indicated that the restriction that is intended to be declared unconventional refers to crimes of high impact and clear social repercussions that were considered serious at the time.
They point out that the figure of informal preventive detention responds to a crime-fighting policy that makes it possible to guarantee adequate conduct of the criminal process and achieve clarification of the facts, protect the victims of crimes, ensure that the person responsible does not go unpunished, as well as ensuring that the damage caused by the crime is repaired.
“We call for the Supreme Court of Justice of the Nation to consider what is stated here, since it is a decision that will directly impact the security and governability of the country and with it on the federal entities, for whose governments we are responsible and Therefore, we have the assessment of those who live and have more than enough elements to issue a founded opinion on the negative consequences that an eventual adverse decision by that Power would have on the security of our governed,” it was stated.
