Government’s recent adoption of emergency ordinance affects seniority of striking teachers

The teachers participating in the strike may have problems with their seniority, after the Government recently adopted an emergency ordinance that was already published in the Official Gazette.

It is about an amendment to the Social Dialogue Law through an OUG, which was published in the Official Gazette and came into force on Thursday, May 25.

Specifically, Law 367/2022 was amended, and in Article 160, paragraph 1, a request by the striking employee for the suspension of the employment contract was introduced. Until now, this suspension was one of law, without being at the initiative of the employee.

For legal suspensions, seniority in a field is not affected, while for suspensions at the request of the employee, the seniority is interrupted.
