The 30% will apply only to those products on the list that are offered as brand-name medications in pharmacies and pharmacies.
The Executive Branch published a new List of Generic Medicines through the framework of Emergency Decree No. 005-2024, where it was increased from 40 to 434 essential medicines (10 times more). However, this does not oblige private sector pharmacies and pharmacies and health establishment pharmacies to have the stock of the 434 medications to comply with the measure.
Regarding the requirement to maintain a minimum stock of 30% of generic medicines in the International Common Denomination (INN), this will apply only to those products existing in the inventory of pharmacies and pharmacies. Thus, if a small pharmacy has 70 different medications and 50 of them are on the new list, the 30% minimum stock will only apply to those 50. This applies to the pharmacy, pharmacy and pharmacy of the private sector health establishment .
In this sense, Emergency Decree No. 005-2024 not only improves access to generic medications for the population, but also guarantees their normal supply in private pharmacies and pharmacies.
For example, for the drug paracetamol, if the pharmacy/apothecary does not market the drug under a brand name, there is no obligation to market it generically. If the pharmacy/apothecary only sells the medication under the brand name, there is an obligation to market it generically. If the pharmacy/apothecary only sells the medication under a generic name, the provision is already met.
In this way, small pharmacies are not required to expand their inventory to include 30% of all drugs on the complete list (434 drugs), but only to ensure that those they already offer in brand names are available in their generic form.
