Gojek-Tokopedia Sued for Rp1.8 T Because of the GoTo Brand

PT Terbit Financial Technology sued PT Aplikasi Karya Anak Bangsa (gojek Indonesia) and PT Tokopedia worth IDR 1.83 trillion. The lawsuit they filed related to brand issues.

The lawsuit was filed by the company through their attorney Mochammad Fatoni to the Central Jakarta District Court on November 1, 2021. The lawsuit was then registered with case number 71/Pdt.Sus-HKI/Merek/2021/PN Niaga Jkt.Pst.

In the lawsuit, they considered the GoTo brand as the result of the Gojek-Tokopedia collaboration with GOTO to be the same as the company’s.

“Declaring that the GOTO, goto, and goto financial brands are substantially similar to those of the plaintiff’s GOTO,” said Terbit Financial Technology’s request in its lawsuit, as quoted CNNIndonesia.com on Monday (8/11).

In addition to the petition, they also asked the judges of the Central Jakarta District Court to grant all other demands, namely stating that the plaintiff is the sole owner and legal right holder of the GOTO registered mark and all its variations.

Then, stated that Gojek-Tokopedia had violated the rights to the plaintiff’s GOTO brand registered under number IDM000858218 at the Directorate General of Intellectual Property of the Ministry of Law and Human Rights.

“Punished the defendants jointly and severally paying material compensation of Rp. 1,836,926,000,000 to the plaintiff,” the lawsuit continued.

The company also sued Gojek-Tokopedia to pay immaterial compensation of Rp. 250 million and forced money (dwangsom) of Rp. 1 billion. Not to forget, Gojek-Tokopedia was asked to stop using the GOTO brand or its variations immediately.

“Punish the defendant to submit and comply with this decision. Stating that this decision can be carried out first even if there are objections or cassation. Punish the defendants to pay the costs of this case,” the lawsuit added.

Meanwhile GoTo Corporate Affairs Astrid Kusumawardhani stated that he was aware of the lawsuit. However, management will study the lawsuit first.

“Currently we are exploring the issue. What we can say is that GoTo always complies with the regulations that apply in Indonesia and will respect the ongoing process,” he concluded.
