Three global hedge funds that made unfair profits through illegal trading and unleveraged short selling were fined 2 billion won.
The Securities and Futures Commission of the Financial Services Commission determined that the stock trading practices of three global hedge funds that occurred during block deal (after-hours block trading) transactions constituted illegal trading, disrupted market order, and violated unleveraged short selling under the Capital Markets Act and reported it to the prosecution. Meanwhile, it was announced on the 20th that it was decided to impose a fine of 2.02 billion won and fines.
According to the Securities and Exchange Commission, global hedge fund Company A placed and executed a sell swap order for shares worth 11.6 billion won in October 2019 in the process of negotiating a block deal price for the shares of Company B, a domestic listed company, with the purpose of lowering the company’s stock price. Company A’s unfair profits resulting from this are estimated to be approximately 3.2 billion won. Company A submitted a non-leveraged short sale order in the process of selling these stocks even before the transaction information was disclosed after the block deal transaction was negotiated.
The Securities and Exchange Commission explained, “This is a violation of short-selling restrictions,” and added, “We judged it to be an illegal transaction as unborrowed short-selling for the purpose of making unfair profits before disclosing important information is recognized as an unfair means.” The Securities and Exchange Commission decided to separately impose a fine of 60 million won as Company A’s violation of short selling restrictions occurred before the introduction of penalties and fines in 2021.
