Gilmar Mendes suspends judgment on inheritance tax on private pensions – CartaExpressa – CartaCapital

The minister Gilmar Mendesof the Federal High Court, stayed an application for a review of the judgment which considers whether the Causa Mortis and Contribution Transfer Tax (ITCMD) applies to the transfer of values ​​from private pension plans as due to the death of the guardian.

Before the test was called off, the score was in 3 to 0 against taxes, presented by the rapporteur, Dias Toffoli, and by ministers Alexandre de Moraes and Flávio Dino.

The trial, which was held in plenary, began last Friday the 23rd. The dean has up to 90 days to return the case for trial.

Currently, states have different rules regarding whether or not ITCMD occurs. The STF seeks one understanding.

In addition to the STF, the Congress also investigates the subject in tax reform. The Chamber of Deputies working group responsible for the second tax reform management project chose to restart the inheritance tax.
