Imagine the following situation:
– A domestic violence report will be filed against you.
– The police reports this cfr duty towards home safely.
– Safe Home misinterprets the message, eg ‘strangulation’ is pasted on you. In addition, it is also reported that you ‘declared in the presence of the police to cause a massacre on your family’.
– Safe at Home brings this in to a Safety House (that’s where the Public Prosecution Service, the police, home safe, probation service, social district team, …) sit at the table. The Public Prosecution Service, Police and Probation Service know the file, but do not report the fact that ‘wrong’ information is being shared.
– The Safety House disseminates this to the emergency services – ie to the social district team and the emergency services deployed.
– You will not see your children for a certain period of time.
– You will not be informed about the above ‘state of affairs’.
A year later you find out, and every participant is shocked that a mistake has been made. You receive letter of apology after letter of apology, but you have not seen your children.
Is this a violation of the GDPR? And would you ask for compensation?
Of in principle not ?
