German Customs Arrests Cars from Russia: An Overview of the EU Embargo and Sanctions

German customs considers entry by private car from Russia as grounds for car arrest. About it writes RBC with reference to the official response of the representative of the Central Information Office of the General Directorate of Customs in Germany.

It states that “the import of passenger cars from Russia into the EU is prohibited in accordance with Article 3i of Regulation 833/2014, which defines the embargo against Russia.” Customs explains that in this context, “importation” actually covers any movement of goods, since the embargo does not provide for exceptions to the prohibition for the specified by you [в запросе РБК] circumstances.”

The publication points out that Article 3i in English states that “acquisition, import or transfer, directly or indirectly, of goods that generate significant income for Russia,” on list XXI, if they are of Russian origin or exported from Russia, is prohibited. At the same time, in German, the official translation of the EU sanctions law uses the term Einfuhr, which can mean simple import (as opposed to customs import).

Each EU member state can independently interpret and implement the sanctions imposed by the Union.

Earlier, the Russians began to report the arrest of cars with Russian numbers at the entrance to Germany. So, Ivan Koval, who lives in Germany, told the publication that on June 1, a car was arrested near his house in Hamburg. The customs officer said that “from October 2022, the entry of cars with Russian license plates into the EU is prohibited” and each country monitors the implementation of sanctions on its own.

According to him, many lawyers refused to take on his case, and the specialist who agreed reported that there was no legal practice on this article. He filed a complaint with the customs office, which, in turn, forwarded it to the Hamburg prosecutor’s office.
