GERB and BSP put a ceiling on fees collected by private bailiffs –

Deputies from GERB will support the changes in the Law on private bailiffs, “Standart” learned. They were proposed by the red MP Strahil Angelov. The changes provide for a cap on all fees collected by private bailiffs. They must not exceed 50% of the total amount of the claim. According to Angelov, private bailiffs currently charge “space” fees. “You can’t owe BGN 500 and they take BGN 5,000 from you in the end, it doesn’t seem fair to me,” commented the red deputy.

In addition to his fellow party members, he received support for the bill from other parliamentary groups. GERB MP Georgi Andonov was the first from the opposition to give him a shoulder. He was adamant that his colleagues would support the new texts that introduce stricter regulation in the sector. “In my opinion, in this way, the balance between private bailiffs and debtors will be restored,” commented Andonov for “Standard”. He will also propose changes to the Civil Procedure Code, which will describe in more detail the ways of notifying debtors of the initiation of proceedings. “Now it is enough for them to simply stick a note on your address and they can now proceed to confiscation of the property,” the GERB deputy is outraged. He added that there are cases where debtors find out about the lien only when the private bailiffs come. According to him, the important thing is to reach a preliminary repayment of the obligations without entering into criminal procedures, as this satisfies both parties in the dispute. Andonov is adamant that the proposal of BSP MPs Boris Tsvetkov and Georgi Kadiev, which foresees the possibility for debtors to appeal property assessments, will also receive support. And if it is not voted in the hall, he will propose it again. The red Strahil Angelov envisages a similar change in the Code of Civil Procedure.

In the texts proposed by him, private bailiffs are prohibited from collecting claims of the state or the municipality.
