ATLANTA — And judge of the state of Georgia has dismissed on Thursday two charges against former US President Donald Trump for the case investigating alleged interference to reverse the results of the 2020 elections in this state.
The case, which remains frozen pending an appeal, now faces eight charges against former President Trump, instead of the 13 that were contained in the original indictment. Democrats.
Judge Scott McAfee, who is presiding over the case against the tycoon, said in his decision that prosecutors do not have the authority to bring charges related to the alleged conspiracy to file false documents in federal court because this is “beyond state jurisdiction.”
Trump’s lawyer Steven Sadow applauded the victory of former President Trump’s legal team in Georgia. “The trial court has decided that counts 15 and 27 of the indictment should be vacated or dismissed,” he said on social media X.
Another charge against Trump allies has been dismissed on the same grounds. However, the judge has decided to keep the case open, so Trump still has eight pending charges for trying to overturn the result of the 2020 election in the state, which was won by the current president, Joe Biden.
The same judge had already dropped six other charges in the indictment last March, including three against Trump, due to the lack of sufficient evidence to reflect in detail the nature of the commission of the crimes in question.
Trump celebrates foul
“The judge has just dismissed two charges against me,” the former president and Republican presidential candidate said in a statement.
“Now we need to get rid of the rest. Why? Because (the charges) are all false and fraudulent,” Trump added.
He also referred to Fulton County District Attorney Fani Willis, whom he describes as corrupt and of having unleashed a “witch hunt” against him.
The judge’s decision is a setback for Democratic prosecutor Fani Willis, another one in her accusation against the former president.
Trump and eight other defendants have sought to have Willis and her office removed from the case, arguing that her romantic relationship with special counsel Nathan Wade represented a conflict of interest. Willis appointed his partner as special counsel in a case that reportedly earned him more than half a million dollars and from which she allegedly profited.
Fulton County Superior Court Judge Scott McAfee asked Willis to remove Wade in mid-March, citing an “appearance of an improper relationship” between the two, but ultimately left the prosecutor in charge in a decision the defense called disappointing.
McAfee granted Trump and the other defendants a request to appeal his ruling to the state Court of Appeals.
“President Trump and his legal team in Georgia have once again prevailed,” Trump’s lawyer said.
