Local operator is said to have cut taxes by 182,850 euros – defendant protested innocence
A restaurateur had to answer for tax evasion in a process at the Salzburg regional court on Friday. The hitherto innocent man was accused of having, as managing director of two restaurants in the city of Salzburg, reduced or tried to cut the taxes to the tax office in the years 2010 to 2015 through incorrect income and sales tax declarations by 182,850 euros. The Salzburg man protested his innocence.
According to the indictment, the cash register system was manipulated. In some cases, table bills were subsequently canceled, said the prosecutor. He also filed an application for an association fine against the accused’s company, as it had also benefited from the tax reductions.
The restaurateur denied the allegations. “He never manipulated anything,” said his defender Andreas Schöppl. The attorney emphasized that the conclusions drawn by the tax office from the computer program were wrong. He did not know why there were gaps in so-called “invoice and journal-its” and how there were time differences in journal debits, the defendant replied to the questions of the presiding judge of the jury’s senate on the subject of “cash management and cash manipulation”.
He also did not know that there was a second program for the “Kassa Touch System”, said the restaurateur. “As a user, I didn’t know how the system worked in the background. I relied on this high-quality system to be certified and that everything was correct as required.” A witness will report that the loopholes are “inherent in the system,” said the defense lawyer. The process will probably be postponed to obtain an opinion.
