Gallardo law firm lawyer discusses employee rights

Jesús Contreras Benítez passed away on October 11 while pruning trees in Menlo Park, California.

The 47-year-old man was from Michoacán, Mexico, and had been in that job for more than two decades.

Contreras Benítez died after falling into a wood chipper. Since it was an industrial accident, the Cal/OSHA state agency has opened an investigation into whether or not the company Jesus worked for was negligent.

Authorities said they received an emergency call, but by the time officers arrived at the scene, the man was succumbed to injuries sustained in the crash.

Jesús was an employee of the FA Bartlett Tree Expert Company, whose website states that it has received awards for the safety of its tree pruning workers for the past 15 years.

Cal/OSHA, the agency in charge of such investigations in the state of California, has indicated that it has up to six months to establish responsibility.

If an accident is found to have been caused by the employer’s negligence, the employer could face fines or even lose their license.
