The former father-in-law of former President Mauricio Funes, Juan Carlos Guzmán Berdugo, must remain in prison, as determined by the First Sentencing Court of San Salvador. Guzmán had been placed under house arrest but the Zacatecoluca prison, where he is imprisoned, did not release him at any time.
“Revoke the alternative measures to detention imposed on the accused Juan Carlos Guzmán Berdugo… and consequently impose the precautionary measure of provisional detention”says the Court’s resolution.
“Solely in order to ensure the appearance of the accused Juan Carlos Guzmán Berdugo, who is under the precautionary measure of house arrest, which has not been possible, but due to the personal circumstances of the accused and the current stage of the process, the need for it is proven,” the prosecutor in the case argued in her request.
The FGR fears that Guzmán Berdugo could escape the country, as he did previously, when he took refuge in Costa Rica, where he was captured and extradited to El Salvador.
The reading of the ruling against him has been scheduled for this Friday, February 16.
“The procedural danger of evasion of justice is proven, due to the personal conditions of the accused, who has shown his ability to escape, since it appears in the judicial file…the extradition process, which implies that can again make a statement like this and therefore – regardless of the decision that is adopted – the ruling cannot be complied with,” the court reasoned.
Guzmán is accused of laundering $133,564.71 during the government of Mauricio Funes through deposits and withdrawals made in the financial system, whose origin was from a private account of the Presidency.
