From Brazil, Dan Wolf Messer –son of the doleiro Darío Messer– made himself available to justice and asked to hold the hearing for the imposition of measures by telematic means.

On May 9, 2018, the Brazilian Dan Wolf Messer was prosecuted for money laundering and criminal association in our country, together with his father Darío Messer, Ilan Grinspun and Juan Pablo Jiménez Viveros (Horacio Cartes’s cousin) and Adolfo Granada.
To date, the Messer are rebellious, but not the other defendants, who have had different procedural outcomes.
Specifically, Jiménez Viveros and Grinspun were sentenced to two years in prison with conditional suspension of the procedure in exchange for donations of G. 10 million each, while Granada obtained a definitive dismissal.
Now, the one who wants to put an end to the process is Dan Wolf Messer.
He first tried to have his case transferred to Brazil, a request that had the endorsement of the Public Ministry, but was unsuccessful at the judicial level.
The guarantee judge Humberto Otazú rejected a request in this regard made by the defense, considering that the Prosecutor’s Office cannot independently manage the transfer of the process as it did, since it is an exclusive power of the court.
Although the Court of Appeal, 1st Chamber, concluded that the Prosecutor’s Office acted irregularly when processing the transfer of the process to Brazil without prior judicial authorization, it decided that the resolution should be annulled because Messer is in default.
Likewise, the chambermaids Gustavo Santander, Gustavo Ocampos and Delio Vera Navarro resolved the cancellation of the legal status of the fugitive’s lawyers, Jorge Bogarín and Bettina Legal Balmaceda, until their client is brought to justice.
For this reason, the file was referred to the criminal court of guarantees in economic crimes No. 2, in charge of José Agustín Delmás.
Now, through a new presentation, Dan Messer himself – under the sponsorship of the same lawyers mentioned above – makes himself available to the Paraguayan justice and asks to hold the hearing of the measures by electronic means. For this purpose, he offers to appear before the General Consulate of Paraguay in Rio de Janeiro, where one of his defenders must travel to assist him.
Ban to leave Brazil and covid
“As a defendant, I am interested in appearing before the jurisdictional and prosecutorial bodies, but having benefited from the accusation awarded in my country, I am prohibited from leaving Brazil for a period of 2 years, in addition to the risk to My health in times of a pandemic that involves traveling to Paraguay, therefore, in accordance with the aforementioned regulations, I request that the hearing for the imposition of measures be carried out electronically (videoconference) via any platform that VS considers convenient, to the effects of complying with the mandates of the Paraguayan justice ”, argues Dan Wolf Messer, in the brief presented by his lawyers.
