French Justice Suspends Municipal Decree Banning Burkini in Fréjus

Justice challenged this Saturday August 5 the municipal decree taken by David Rachline, mayor (RN) of Fréjus.

Tuesday, August 2, the municipality of Fréjus communicated on the ban on the burkini for swimming on its beaches, considering that this outfit is “not compatible with the basic rules of hygiene, in the context of swimming in the maritime public space”.

Only, the human rights league challenged before the administrative court of Toulon this municipal decree taken by the municipality led by the councilor of the National Rally, David Rachline.

During a hearing this Saturday, August 5, the French justice decided to suspend the said decree.

In a new press release published on X (formerly twitter) the mayor declares that it is “a decision which goes against the general interest that I defend, which goes against the security of our fellow citizens and which goes against the basic rules of hygiene.” David Rachline believes that “this is a very bad signal sent to a worried population which is in deep demand for tranquility and security in the public space”.

Marion Ogier, lawyer and member of the national committee of the LDH, reacted to the suspension of this decree by the justice “On the appeal of the @LDH_Fr, the judge in chambers has just suspended this ban and condemn the city to pay 3000 euros The Burkini is no longer prohibited on the beaches of Fréjus!”

Last July, the Council of State invalidated a similar decree in Mandelieu-la-Napoule in the Bouches-du-Rhône.
