The Freiburg lawyer Udo Kauß wants to sue the health department of the Breisgau-Hochschwarzwald district office for the surrender of data. He requested information from the authority about the exact causes of death of the people who died in connection with a coronavirus infection in Freiburg and the district. However, he did not receive this data.

From Kauß’s point of view, the phrase “in connection with corona deceased” is not precise enough. The health authorities could give more precise causes of death. He tried in vain to receive this data in anonymous form from the health department, which is also responsible for the city of Freiburg. For this reason, he decided to file a lawsuit with the Freiburg Administrative Court.

The health authorities would become aware of the cause of death as part of the mandatory medical examination of every deceased. “These are meticulously queried in the so-called death certificates about the presumed immediate cause of death or previous causes and basic ailments or causes of accidents,” says a message from the national association of the Humanist Union, which supports the lawsuit.

Kauß wanted to see this information. But that was rejected by the Administrative Court of Baden-Württemberg, among others. Reason: Even if the office were only to provide this data anonymously, the lawyer could find out the identity of the deceased by adding other data. This is not compatible with the need to protect the bereaved. The lawyer continues to push for the data to be released.

The right-wing extremist spectrum of politics in particular would exploit this for its own purposes.

The district office of Breisgau-Hochschwarzwald, to which the health department is affiliated, could not comment on the process on Thursday, as press spokesman Matthias Fetterer announced when asked.
