A few citizens from Gutach took action against the wind turbine on Tännlebühl, 20 km north of Freiburg, which essentially belongs to numerous citizens from Freiamt and the Elztal. The operator, the Ökostromgruppe Freiburg, had already pointed out that the alleged facts on the basis of which the permit was supposed to be illegal are inaccurate or fictitious. For example, this concerned the subjects of “species protection” and “oppressive effect”. The regional council rejected the objection to the approval of the Emmendingen District Office with detailed reasons. The arguments of the regional council were easy to understand even for laypeople. Nevertheless, a lawsuit was filed with the Administrative Court of Freiburg. The VG dismissed all points of the action after several years and holding an on-site visit. An appeal was then filed with the Administrative Court of Baden-Württemberg. This application was rejected in September 2020 as there was no doubt about the correctness of the VG’s judgment. The green electricity group in Freiburg sees its approach confirmed by the judiciary. Andreas Markowsky, Managing Director of the Ökostromgruppe Freiburg, states: “As happened with the Tännlebühl project, it is important to inform the public at an early stage and also to offer financial participation opportunities. Expert opinions are to be prepared with the utmost care. If individual opponents are inaccessible to factual arguments, this cannot be a reason not to build wind turbines. The energy transition and climate protection are simply too important for future generations ”.
