I. – Foreign nationals who have reached the age of eighteen and whose residence permit or receipt for residence permit application states that they have requested asylum may benefit from a temporary waiting allowance. in France and who have submitted a request to benefit from refugee status, if they satisfy a means test.
Persons who come from a country for which the French Office for the Protection of Refugees and Stateless Persons has decided to implement the stipulations of 5 of C of Article 1 of the Geneva Convention of July 28, 1951 relating to the status of refugees, or from a country considered to be a safe country of origin, within the meaning of 2° of article L. 741-4 of the code of entry and stay of foreigners and right to asylum, with the exception of humanitarian cases reported by the French Office for the Protection of Refugees and Stateless Persons under the conditions provided for by the decree mentioned in article L. 351-9-5.
II. – Foreign nationals who are beneficiaries of temporary protection may also benefit from the allowance, under the conditions provided for in Title I of Book VIII of the Code of Entry and Stay of Foreigners and the Right to Asylum, and, for a period determined, foreign nationals benefiting from subsidiary protection, foreign nationals to whom a temporary residence card has been issued pursuant to article L. 316-1 of the same code, as well as certain categories of people awaiting reintegration.
