It’s missed. Last Thursday, May 25, the Council of State dismissed the National Union of Rhône Landlords (UNPI 69) which demanded the cancellation of the perimeter of rent control in the Lyon area, namely Lyon and Villeurbanne. In other words, with its decision no. 458155 very technical in appearance, the highest administrative court in the country has validated one of the political markers of the ecological majority of the Metropolis of Lyon.
The Council of State considers that the “reference rents”, in force within the framework of the system tested since November 2021, are “likely to limit the exercise of the right of ownership” but that this limitation “presents a reasonable relationship of proportionality with the requirement of general interest that it pursues”. Namely: “To fight against the major difficulties, in particular of a financial nature, of access to housing (…) in certain urbanized areas. »
Rent control: in Lyon and Villeurbanne, tenants still pay too much
Median rent at 12.6 euros per square meter
The UNPI also attacked the decree which fixed the perimeter on the criterion of a “high median rent level”. In vain: the decision rendered last Thursday considers that “the level of the median rent of Lyon, of 12.6 euros per square meter, higher by approximately 18% than that of the rest of the Lyon conurbation, is high” and that the pace of new housing construction is too low to rebalance supply and demand.
Allowed since a 2018 law, at the request of local authorities, rent control was first tested in Paris and Lille, before being adopted by Lyon and Villeurbanne, Bordeaux, Montpellier or municipalities in Ile- de-France (Montreuil, Bagnolet, Aubervilliers, La Courneuve…). Its effectiveness has yet to be demonstrated: last November, a year after its application in Greater Lyon, a barometer by the Abbé Pierre foundation revealed that more than one out of three real estate advertisements exceeded the regulatory ceilings.
