Fracture among Spanish prosecutors over the accusation of Álvaro García Ortiz

Madrid. The day after having starred in practically all the newspaper covers and radio and television news programs, the State Attorney General, Álvaro García Ortiz, had an intense day, in which he confirmed the fracture between the Spanish prosecutors regarding his continuity in the charge after his indictment in the Supreme Court for an alleged crime of revealing secrets. The highest representative of the Prosecutor’s Office, the first in history to be prosecuted for a crime in the exercise of his position, obtained on the one hand the support of the Board of Prosecutors, the majority of whom were related and appointed by himself, but was urged to resign. in charge by the majority of the Fiscal Council, in which the three major currents of the career are represented.

García Ortiz is being investigated by the Criminal Chamber of the Supreme Court for an alleged crime of revealing secrets, following the leak of a series of emails related to the tax fraud case of Alberto González Amador, romantic partner of the president of the Community of Madrid, the right-wing Isabel Díaz Ayuso. The attorney general intervened in the case to try to stop what he considered a “hoax” promoted by the Madrid right to try to maintain “the story” that it had been the Prosecutor’s Office that had proposed an agreement to González Amador to avoid jail. when in reality it had been the defense of the alleged tax fraudster that had done it. From there there are a series of leaks to the media that the justice system will now have to judge to assess whether the attorney general committed a crime.

After having received the support of the Board of Prosecutors, García Ortiz met with the Fiscal Council, which did urge him by majority to present his resignation so as not to further damage the credibility of the institution he represents. He only received the support of the two members of the Progressive Union of Prosecutors (UPF) and two other independent members. The rest, seven in total, urged him to resign as soon as possible. However, the progressive prosecutors reiterated their support with a public statement in which they reiterated their “firm support for the decision of the State Attorney General not to present his resignation. Reasons of a moral and institutional nature and the content of the judicial resolution support this support,” they stated.

García Ortiz also has the support of the full government, chaired by the socialist Pedro Sánchez, who appointed him to office, and of the two parties that make up the coalition, the Spanish Socialist Workers Party (PSOE) and Sumar.
