The President of the Labor Party who is also the President of KSPI Said Iqbal revealed 4 things that made companies not pay THR. Firstworkers are still in the process of being laid off due to industrial relations cases.

“There were those who were laid off in January 2023 or since 2022. But the layoff cases have not been completed or are still in process. Because there has been no decision that has permanent legal force, the company should still be obliged to pay THR. Unfortunately, many companies do not pay THR on workers who are in the process of disputes over layoffs,” explained Said Iqbal in a written statement, quoted on Saturday (22/4/2023).

Second, before H-30 Eid, many contract employees were laid off. Then, after Eid, the workers will be contracted again.


According to Said Iqbal, this is a mode that occurs repeatedly every year. To prevent this kind of mode from continuing throughout the year, the regulations regarding THR need to be changed. Namely, the THR payment is H-30, no longer H-7.

“Because there is an increased need for production before the holidays, for example in the textile, garment, food industries; companies can no longer pretend to layoffs ahead of the holiday if D-30 THR is mandatory,” he said

In addition, the provision of THR H-30 also gives time for workers who do not get THR to dispute it. Because if the THR is given H-7, workers who do not get THR according to the regulations cannot do much, because they are already on the Eid holiday.

Third, many companies that promise to pay THR are not H-7, but H-1 or D-2. As a result, when D-1 does not pay the THR, it can no longer be sued or reported because the company has entered the holiday.

Fourth“There are still companies that pay THR in installments or are paid below the labor wage,” he continued.

Meanwhile, industries that always have problems related to THR are the garment and textile industries. shoes, electronic components, food, beverages, small and medium chemical industries, and several hospitals.

“The industry often doesn’t pay THR, or the THR is paid in installments, and it’s not according to the rules,” said Said Iqbal.

Said Iqbal also examined THR payments for contract employees in hospitals or BUMN industries, which according to him many were not according to the rules. Including teachers and temporary staff. The Labor Party and KSPI are currently collecting data and will have a problem when honorary workers and teachers in government agencies and BUMN outsourcing THR are not paid according to the rules.

“BUMN and government agencies should be at the forefront of complying with regulations. Instead of violating THR payments,” said Said Iqbal.
