A forty-year-old lost his temper while his wife was organizing the birthday of one of their children. The woman suffered a broken wrist and was given 30 days of ITT while one of the sons was kicked while on the ground.

“I made a big mistake,” assures this defendant who was tried on Monday, November 13, at the Thionville judicial court. Until then unknown to the courts, this forty-year-old, father of three children, had to answer for aggravated violence against his wife, with ITT (temporary incapacity for work), and for violence against one of his minor sons, without ITT. Events which took place last June at the family home in Gandrange. After receiving a resin chair thrown by the defendant, the wife found herself with a broken wrist which caused a 30-day ITT. The son, who had tried to intervene during the altercation between his parents, was grabbed by the neck by the defendant. To defend his mother, one of the children then grabbed a knife which he pointed at the father.

A few hours later, when the eldest returned from the hospital where he had accompanied his mother, he was attacked by the forty-year-old to the point of finding himself on the ground and being kicked. Following the events, the forty-year-old was placed under judicial supervision with a ban on appearing at the family home. “How can an argument over a birthday generate such violence? », asks the president. “I had worked at night, I was tired…” replies the person concerned while admitting to a previous slap administered to his wife a few years ago. The president deplores “a particular mode of communication in this couple”. At the bar, the wife, who does not intend to become a civil party, indicates: “I forgive but I do not forget. »
“Fears about the future and risk of recurrence”
The representative of the prosecution underlines “the futile nature of this surge of violence for a child’s birthday”. The magistrate admits to having “fears about the future and the risk of recurrence” of the accused. It requires 10 months with probationary suspension for 24 months accompanied by various obligations and a ban on appearing at the victim’s home for one year. “We are all likely, one day, to slip when something goes wrong,” argues Samira Djeffel (Metz) in defense. The defendant* was sentenced in accordance with the requisitions. He is banned from having contact with his wife for 6 months.
