The District Prosecutor’s Office in Varna filed an indictment in the Varna District Court for the pollution of Lake Varna by a sewage pipe. Three persons have been charged, including the former mayor of Varna, Ivan Portnih, according to the state prosecution.
He is being held criminally liable for allowing the sea waters to be polluted. This action has led to considerable damage to the environment.

The Penal Code stipulates for this crime a penalty of “imprisonment” from 2 to 8 years and a fine from 10,000 to 50,000 BGN. The former mayor of the seaside town has been charged and that, as an official, he did not take sufficient care to lead, the management of the work assigned to him and this has resulted in significant damage on a particularly large scale, constituting a particularly serious case.The penalty for this offense is from 3 to 10 years in prison.
The other defendants for the incident are Botyo T., manager of the company “BT-Engineering” EOOD, which specializes in consulting, design and engineering services in the field of the environment and waste management.
Charges have also been brought against Tsvetanka B. by the same company, which was one of the members of the State Reception Commission, which established the suitability for use of the project “Transformation of a waste water treatment plant in the Varna region “Asparuhovo” into a pumping station and transport pipeline”. .
The prosecutor’s office has charged them with document fraud on a particularly large scale, representing a particularly serious case, for which in the Criminal Code the punishment is “imprisonment” from 10 to 20 years.
The pre-trial proceedings were initiated in 2020 according to the inventory of the National Investigation Service. There are 114 volumes of materials submitted to the court from the investigation.
The case is to be assigned to a panel of the District Court – Varna, and a dispositive hearing will be scheduled, at which it will be decided whether the court is subjudicial, in what order it will proceed, whether a recusal of the panel will be requested, as well as whether the pre-trial proceedings, significant procedural violations were committed, which violated the rights of the defendants.
