The former district councillor of Tsui Ping District, Kwun Tong, Cheng Qiang-feng, ran for re-election in the 2019 District Council election, but eventually lost to the Democratic Party Hung Chunxuan by 381 votes. Zheng Qiangfeng filed an election petition the year before, alleging that the information on the leaflets distributed by Hong Junxuan when canvassing votes was misleading and suspected of malicious smear. Judge Zhou Jiaming issued a verdict today, approving Zheng Qiangfeng’s election petition, ruled that Hong Junxuan was not properly elected, and ordered Hong Junxuan to pay Zheng Qiangfeng’s legal costs.
This is the first DQ case of a district council in 2019, and it is also the first election petition for the establishment to win.
Hong Junxuan’s canvassing leaflet printed Zheng Qiangfeng’s photo and wrote: “Beware of fake democracy and betray the royalist party of popular opinion”, “reported independence”, “independent? During the trial, Zheng Qiangfeng’s lawyer pointed out that Zheng Qiangfeng did not claim to be “independent” and has always disclosed that he is a member of the “Building Power” and the “Public Housing Association.” Hong Junxuan refers to “independence” which means that a person does not belong to any political party or organization.
Zhou Guan said that “independence” means that the candidate is not affiliated with any political party, prescribed political group, prescribed non-political group, organization, political group, etc., nor is nominated or supported by any political party. Zheng stated that he publicly stated that he was affiliated with the “Creative Force” and the “Public Housing Federation” and never claimed to be “independent.” Zhou ruled that Hong Junxuan published misleading statements about Zheng Qiangfeng on the canvassing leaflet, and therefore approved Zheng Qiangfeng’s election petition. , Announced that Hong Junxuan was incorrectly elected.
